Terms of Service

1. Agreement to terms

By creating an EngX account or using EngX, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use EngX.

2. Eligibility / account requirements

You must be at least 16 years old to create an EngX account. If you are under the age of majority where you live, you may use EngX only with permission from a parent or legal guardian. You are responsible for providing accurate account information and for complying with any additional age requirements that apply where you live.

3. Account responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly if you suspect unauthorized access.

4. Acceptable use

Use EngX only for its intended purpose — practicing and learning engineering problem-solving. Do not attempt to circumvent grading, access another user's data, disrupt the service, or use EngX for any unlawful purpose.

5. Prohibited conduct

• Attempting to access accounts, data, or systems you're not authorized to access.
• Reverse-engineering, scraping, or automating interactions with EngX beyond normal use.
• Uploading unlawful, infringing, or abusive content (including via issue reports or profile pictures).
• Interfering with the security or integrity of the platform.

6. Educational nature of EngX

EngX provides engineering practice problems and educational tools. Content, feedback, and automated grading are provided for learning and self-assessment purposes.

7. No professional engineering advice

EngX's content, problems, and generated explanations are educational only. They are not professional engineering advice, are not a substitute for the judgment of a licensed professional engineer or your instructor, and may contain errors. You remain solely responsible for the academic and professional decisions you make, including any reliance on EngX content in real-world engineering work.

8. User submissions / content

You retain ownership of content you submit to EngX (such as issue-report descriptions, screenshots, and profile information). By submitting it, you grant EngX a license to use it solely to operate and improve the service (e.g., reviewing bug reports, displaying your profile back to you).

9. EngX intellectual property

The EngX platform, brand, and problem library (excluding your own submissions) are owned by EngX or its licensors. You may not copy, redistribute, or create derivative works from EngX content outside of normal personal use of the product.

10. Problem / content licensing

Access to problem content is governed by your subscription tier (§11). Problem content is licensed for your personal learning use only, not for redistribution or commercial use.

11. Subscription tiers

EngX currently offers a Free tier and one or more paid subscription tiers with expanded problem access, billed monthly through Stripe. Exact tier names, feature sets, and prices are shown on the Pricing page and are subject to change; the Pricing page, not this document, is the current source of truth for pricing.

12. Pricing

Paid tier prices are displayed before checkout. EngX may change prices for future billing periods. If a change affects an existing subscription, we will provide advance notice when required by applicable law and will not apply the new price before the effective date stated in that notice.

13. Billing

Paid subscriptions are billed through Stripe. By subscribing, you authorize EngX (via Stripe) to charge your payment method on a recurring basis for your selected tier.

14. Renewal

Paid subscriptions renew automatically at the end of each billing period unless cancelled beforehand.

15. Cancellation

You can cancel your subscription at any time through the Stripe billing portal, accessible from Settings. If you delete your EngX account, any active subscription is cancelled immediately as part of account deletion, rather than continuing until the end of the current billing period — because access is being permanently revoked at that point.

16. Refunds

Except where applicable law requires otherwise, subscription charges are non-refundable once processed. Cancelling prevents future renewals and normally leaves paid access active until the end of the current billing period. If you believe a charge was made in error, contact support@engx.app. Nothing in this section limits any refund, cancellation, or other remedy that cannot lawfully be excluded.

17. Free / paid feature availability

Feature availability by tier is described on the Pricing page. Free-tier access does not require a credit card.

18. Changes to the service / features

EngX may add, modify, or remove features at any time as the product evolves. We will make reasonable efforts to avoid materially reducing what a paying subscriber has already paid for within a current billing period.

19. Account suspension / termination

We may suspend or terminate accounts that violate §4–5 of these Terms. Administrators can disable or remove accounts through EngX's internal admin tools.

20. User-initiated deletion

You may permanently delete your own account at any time from Settings → Privacy Centre → Danger Zone. See our Privacy Policy §23 for what deletion does and does not remove.

21. Third-party services

EngX relies on third-party service providers (authentication/hosting, payments, analytics — see Privacy Policy §20) to operate. EngX is not responsible for the availability or acts of these third parties beyond our own integration with them.

22. Service availability

EngX is provided on an "as available" basis. We do not guarantee uninterrupted or error-free operation.

23. Accuracy / disclaimer

EngX's problem content, automated grading, and any AI-assisted explanations may contain errors. EngX makes no warranty as to the accuracy or completeness of any content. See §7 (no professional engineering advice).

24. Limitation of liability

To the maximum extent permitted by applicable law, EngX and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or opportunities arising from your use of the service. For claims that may lawfully be limited, EngX's aggregate liability will not exceed the greater of (a) the amount you paid EngX in the 12 months before the event giving rise to the claim and (b) CAD $100. This section does not limit liability that cannot legally be limited or excluded.

25. Indemnity

To the extent permitted by applicable law, you agree to indemnify and hold EngX and its operators harmless from third-party claims, losses, and reasonable costs arising from your unlawful use of the service, your infringement of another person's rights, or content you submit in violation of these Terms. This obligation does not apply to the extent a claim results from EngX's own unlawful conduct.

26. Governing law / jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules. Subject to any non-waivable rights you have under applicable consumer law, disputes may be brought in the courts located in Ontario, Canada. These Terms do not require arbitration and do not include a class-action waiver.

27. Changes to these Terms

We may update these Terms as EngX's product and business practices change. The version number and effective date at the top of this page will be updated when the Terms change. For changes that materially affect existing users' rights or obligations, we will provide additional notice when required by applicable law or when reasonably practicable.
